a single instance of posting a .gif is not equivalent to the primary offense - that's the problem. you're making an assumption of future behavior and condensing an entire history of offense into a single largely harmless action.

using your own (awful) analogy, its like charging a murderer with the full extent of past offenses because of a minor offense like littering.

They aren't suddenly absolved of murder when there is proof of the crime.
