You can use whatever you want, but MSPaint is a basic program that has what you needs and is installed on Windows anyways.
Just keep in mind that you should stay away from tools that take away your pixel precise control, such as anti-aliased brushes, gradient tools, filters etc. :>

I have PhotoShop CS6, could that also work?

you could try, but it'd just make the process more complicated, as PS isn't made for pixel art.
if you want to, though, give it a go I guess! see how it works out.

Well anything that lets you make pictures by placing single pixels would work Tongue
On PS, you can use the pen tool (not the brush!) and set it's size to 1px.

By the way, quick question, is it allowed to make sprites of a image?
Like making a sprite based on a image.
Not copying it in sprite version or or making same pose in sprites or something, but only as a example to look how the character looks like.
That's allowed?

Sure, that's called "using a reference". It's even adviced to use images of a character for reference when spriting it, so you can make sure you get the features and proportions right and all that. Also to make sure you don't end up making a sprite of some completely different character Tongue
