I don't see why people are getting so bent out of shape about this. It makes sense; LPers really shouldn't be making money off of playing through a game they didn't make, or at least get permission to make money off of. If they really just wanted to show the game off, they can do it without monetizing their video.

I don't see why people are getting so bent out of shape about this. It makes sense; LPers really shouldn't be making money off of playing through a game they didn't make, or at least get permission to make money off of. And why should Nintendo make the money off a video they did not make either? This is really ridiculous, a lot of LPers actually put hard work and time into making enjoyable content and they're getting pretty much screwed over by this.

Not really. The only things they are entitled to are their own commentary and edits, but the actual game is not theirs. It's no different than making a t-shirt of sonic characters, and trying to sell it. It's illegal to do that. Now if you made the shirts and gave them out for free in some way, like a contest prize or something, that's perfectly legal and falls under fair use.

Since LPs are generally a full run of the game, it's perfectly reasonable for the creators/publishers of the game to get the money LPers are trying to reap from making videos of the whole thing.

So it's illegal to review a movie, or a book or a game and profit over it, huh?

If you broadcast the entire contents of it then yes. If it's a review that only uses certain samples to get a point across, it's perfectly legal. Again, review Fair Use. You can even read up on it on Wikipedia. This only affects those trying to make money off of content that isn't theirs by the way. If you're doing LPs without monetizing your videos, you're perfectly fine, and none of this applies to you.

Yes, but fair use is very fuzzy in the context of video games. Unless a LPer performed every action at every point on the snap grid, they did not demonstrate the entirety of the game.

Editing to add: I don't have an issue with Nintendo profiting from Let's Play videos which showcase their material, but I do feel like there should be split profits with the owner and creator of the commentary and video editing which is as responsible for the profit as the game itself is.

Me, mostly. I only ad block porn because most porn site ads are malicious and I feel better with it on. But for sites like this I have white listed.
So I guess I'm the asshole.
I use adblock too.

I dont understand why people get mad at this. Its like flicking around channels to avoid ads, and guess what, they are still up and running. Also it makes the sites nicer looking. Ads are a pain in the ass most of the time no matter their purpose.

Though i dont block them when i use my tablet to access stuff, so i am not a "complete asshole".

The 'entirety' in this case, I believe, means 'a huge part of the game'. Playing a game until the end and recording your progress is considerable enough to be considered 'entirety'. If it's just an excerpt of it, a showcasing of a glitch, or a single level, that wouldn't be 'entirety'.

and honestly, I think i'd do the same if I made a commercial game.

No, but in a perfect world that would be logical.

In our imperfect world, though, movies and games are different. Since Let's Plays are part of a cinematic medium and video games are part of an interactive medium they aren't considered competition, whereas movies are part of the same medium as Let's Plays. So that's why that wouldn't be legal.

Frankly I don't want to offend anyone, but adblocking IS an asshole move, especially if you've been around long enough in the internet to not fall for ad traps.

No, it's nothing like flicking around channels to avoid ad, that's a 100% innacurate comparison.

Think like this, TV ads are paid beforehand to the broadcaster to be there. Youtube ads aren't, the content creator will only get any share of the money IF the ad is seen (and more if clicked), so you're basically, with ad-blocking, blocking the income of a thousand of people (not just youtube, mind you) just because you don't want a minor annoyance on your screen. It's really gets me angry how people don't get how much bad ad-block does for people who live off the internet, you're getting the content for free anyway, what's the problem with supporting them by losing like 2 seconds to close an ad or just ignore it on the side of the screen? That's extremely selfish.

yes you could actually, just not make money out of it....unless you added commentary. See, what people aren't understanding here is that LPers aren't just playing through the game, it's not just a plain walkthrough in most of the cases, they have WORK put on it. Be it improvising, or writing a text or segment. Are you really against people making money off their hard work? I mean, sure, the game's not theirs, but LPs actually give Nintendo free publicity, it's word of mouth but on a higher level. Even people like JonTron or PeanutButterGamer are getting screwed over, and they make videos that are MUCH MORE than just playing the game, with humor, writing and a lot of editing. I think people who are supporting Nintendo here are being extremely superficial about it.
In all honesty, It isn't that big of a deal that they are doing this, the only thing that bothers me is that they are already basically getting free advertising of the game the person is doing an LP for, because if the LPer is doing things right, they will make you want to at the very least play the game yourself.
It doesnt change a thing on my side because i dont watch LPs anyway.

I use adblock mainly to block annoying stuff. As the app itself says, its a way to take down abusive and annoying contents that spawn sometimes. This means i dont block things that dont disrupt browsing. (also i leave other internet browsing devices free of adblocking apps). And my mom is one of those people who still didnt spent a good time on the internet so theres that too.

Also i am going to join koh's side this time, if they want to make money out of LPs they should contact the game makers about it, or not monetize their videos at all. I believe thats how most review shows work and idont think it should be different. Considering that there are companies that would just take those videos off.
